International Military Tribunal in 1946, ”[d]irect and public incitement to commit genocide“ was forbidden by the Genocide Convention (1948), Article 3.

The International Convention on the Elimination of All Forms of Racial Discrimination (1965) prohibits “all dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination, as well as all acts of violence or incitement to such acts against any race or group of persons of another colour or ethnic origin”.

Article 25(3)(e) of the Rome Statute of the International Criminal Court.According to the Rome Statue, incitement is not “a crime in its own right” and an inchoate offense, as it was considered in previous prosecutions, but simply one possible “mode of criminal participation in genocide”.
